These Terms of Use (“Terms”) govern your use of qualigent.tech and any related websites we operate (together, the “Site”), together with any mobile applications we publish that link to these Terms — including apps distributed through app stores such as the Google Play Store (the “Apps”, and together with the Site, the “Services”). By accessing or using the Services you agree to these Terms. If you do not agree, please do not use the Services.
About us
The Site is operated by Qualigent Technologies Private Limited, a company incorporated under the Companies Act, 2013 (CIN: U62013KA2026PTC219874), with its registered office at Fennel 7d, Klassik Landmark, Junnasandra Off Hosa Road, Near Amritha College of Engineering, Bengaluru, Karnataka 560035, India.
What this Site is
The Site is an informational and marketing platform for our company and the products we build. Our business, as set out in our Memorandum of Association, is to design, develop and deploy software applications, technology platforms and AI-powered digital products for educational institutions, retail consumers and enterprises, and to provide information-technology consulting, software development and related services in India and abroad.
Nothing on the Site constitutes a binding offer, contract or commitment by Qualigent. Engagements with us are entered into separately under written agreements.
Acceptable use
You agree to use the Site only for lawful purposes. You will not:
- attempt to gain unauthorised access to any part of the Site or its underlying systems;
- use automated scrapers, bots or any mechanism that places an unreasonable load on our infrastructure (legitimate search-engine indexing is permitted);
- reproduce, distribute, modify or commercially exploit content from the Site without our prior written permission;
- use the Site to transmit malicious code, conduct phishing or violate any third party’s rights;
- misrepresent your identity or affiliation when contacting us through the Site.
Apps and app stores
We make some products available as mobile applications, including through the Google Play Store. Your use of an App is also subject to the terms and privacy policy of that specific product and to the rules of the app store you obtained it from (for example, the Google Play Terms of Service). If a product’s own terms conflict with these Terms in respect of that App, the product terms govern for that App.
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable licence to install and use our Apps on a device you own or control. You must not copy, modify, reverse-engineer, redistribute or resell an App except to the extent permitted by law. Apps may update automatically, some features require an account and a network connection, and your mobile carrier may charge you for data.
Where you obtain an App from the Google Play Store, you acknowledge that Google is not a party to these Terms and is not responsible for the App or its content. To the extent required by Google Play, Google and its affiliates are third-party beneficiaries of these Terms and may enforce them against you.
Intellectual property
All content on the Site — including the Qualigent name and logo, product names (such as GitReady and MySkul), copy, design, code and product imagery — is owned by Qualigent or licensed to us, and is protected by Indian and international intellectual-property laws. You are granted a limited, non-exclusive, non-transferable licence to view this content for personal, non-commercial purposes only.
Third-party links and products
The Site may link to external websites and to our own products hosted at separate domains (such as gitready.app and myskul.com). Each of those products is governed by its own terms and privacy policy. We are not responsible for the content, practices or availability of any third-party site you reach from a link on the Site.
Disclaimers
The Site is provided on an “as is” and “as available” basis. While we work to keep information accurate and up to date, we make no warranties — express or implied — regarding the Site’s reliability, completeness, accuracy or fitness for any particular purpose. Any reliance you place on information on the Site is at your own risk.
Limitation of liability
To the fullest extent permitted by applicable law, Qualigent and its directors, employees and contractors shall not be liable for any indirect, incidental, special, consequential or punitive loss — including loss of profits, data or goodwill — arising out of or in connection with your use of, or inability to use, the Services.
Indemnification
You agree to indemnify and hold Qualigent harmless from any claim or demand — including reasonable legal fees — made by any third party arising out of your breach of these Terms or your misuse of the Services.
Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Services.
Changes
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Continued use of the Services after a change constitutes acceptance of the updated Terms.
